There were about 400 people lined up at our local store at 6:00am. I surprised more people are not hurt from the "Black Friday" of shopping. I don't know what I would do if I could not get my child a tickle me elmo for X-MAS!

Not only that, but for a $29.00 DVD player? That is called a huge, smelly, POS.

The best part is how WallMart called later that day to say they were sorry and offered to put a DVD player ON HOLD for her?!?!?!?! What, is giving away a $29.00 DVD player too big of a deal?!?!?!?!

Sounds like grounds for a good lawsuit!

These stores need to be stopped from creating such frenzies by offering these 'deals' for the first thirty minutes their open and such. A couple good lawsuits like the one I see coming from this incident ought to put a stop to it. :)

It doesn't matter whether you disagree or not Shockwave.

The simple fact is that by having these type of sales they incite frenzy in their customers and the trampling is a direct result. This IS the grounds for a succesful lawsuit.

bestbuy seemed to handle their sales well...


They are different classes of people who MOSTLY shop at these two different stores...


Bestbuy=Upstanding black white asian hispanic etc people who seem to have a good carrer...

Walmart=Hoosier black white people who seem to go nuts over the silliest deals

I dont' mean to be rude here, but I think filing a lawsuit over something like this is silly. If someone does sue, good for them, but I don't think it's the companies fault that some people can't show common sense.

Things happen in life. There are risks with everything we do. We can't go around suing the pants of everything and everyone when something bad happens. When a company actually does something that puts their customers in HARMS WAY, then I could see a lawsuit being succesful, but in this case....I just don't think it would hold up in court.

Actually, it happened on Wallmart's property, it IS there fault. Doesn't matter if they had a 30 minute sale or not that kicked it off, they are responsible in the eyes of the law.

Adding this 30 minute sale to have this frenzy will only hurt them in court. It is also Wallmart's fault these people went into a frenzy. What do they think would happen? Everyone would get into a single file line and each take their turn getting one?

No, everyone is going to rush to it and run over anyone in their way.

I wouldn't be suprised if they had 0 crowd control, either. Not even a roped off line.

Interesting, a friend of mine is a lawyer, and said this could easily fall under the legal defination of 'attractive nuisance,' which would put WM in a bind legally.

While it applies to children being drawn to property to play in/with something dangerous, something similar could get WM in trouble.

I work at Best Buy and our "Black Friday" is amazing. 1000 people lined up down the street and then they all run in. If we didn't keep thing's organized and someone got hurt, I would hope that customer would sue us. It is our responsibility to keep things organized.
