Yup, you can thank the creators of the Patriot act for that. Overall, I agree with the need for it, but I think they rushed too quickly to get it enacted and as a result, gave some sections of Gov't a little too much power.

Hopefully the Pat act will be revised. I know that a lot of congress is opposed to keeping all the items in it indefinitely.
