I wouldn't be whining and crying. But if I was in the right, I *would* be out in the street with my AK and see if the asshole wants to still tow my car away. Only if I was right though. The tow truck driver was basically taunting the crybaby. Normally those guys get the vehicle then hustle out there quick as can be (to avoid assholes coming out with guns :lol: ) and then let everyone settle their affairs later. This guy saw that the kid was no threat and decided to enjoy his misery a bit.

There's a TV show devoted to this kind of thing. I was watching the other night, they went to tow some guy's car, the guy and his younger brother came out and confronted him. After a scuffle, the younger brother cracked off a round from a little .22 rifle, the tow truck driver and his partner took the gun from the kid and broke it. Then the cops showed up and actually told the tow truck driver to leave (without the car) to settle the peace. The guy (whose car was being towed) was probably in the wrong, but I felt good somehow that he got to keep the car that night. I guess I was just rooting for the underdog. That kid in the videoclip makes it hard to root for him though.

That cop doesn't sound like he was following the law. It sounds like he was making the law. I know in cases of trespass the law is 100% on the side of the land owner and tow truck driver. If a cop is called and someone is protesting it they will get nowhere and may end up arrested if they continue.

The tow truck driver in the clip might have wanted an easy pay-off. In Mass law (I guess it's the same elsewhere but it could be different) once a truck is dispatched for trespass (I think that's right. I looked it up years ago), he has a right to collect money. In practice however, it is when you have a car on the hook and the person comes out before you drive away. They do this because it's sure quick money and in some ways it's preferrable to potentially having a car sit in a lot for months after which you have to get the title allowing you to sell it to finally get your money.
There are always confrontations when trespass towing. It's a shitty shitty job. Imagine if you would towing from a lot in back of a jail and having 15 guards (wannabe cops) from the jail surround your truck threatening you with all kinds of bodily harm if you don't put one of their cars down.

The clip I saw on TV wasn't a parked-in-the-wrong-place type situation,it was a repossession for not paying the car payment type of thing.
Sometimes, for better or worse, cops do this kind of thing. Had he followed the law (for better or worse) he would have had to arrest about 5 people for assault, including the tow truck driver and his partner, the guy and his younger brother, and some other guy who's showed up and got involved (at one point they were all kind of wrestling around). The kid fired a round from the .22 rifle, I think he fired it straight up--that kid would be cited for firing within city limits, maybe much, much more. Then the tow truck driver gets charged with something for smashing the kid's rifle in the street. Remember, the people give their statements, the cop just makes the arrest, the courts sort it all out months later. It would have meant about half a dozen criminal trials, probably followed by a few more civil cases. The only people who would win in this situation is....the lawyers! ;)
I might have done things differently, but then again that cop probably saved everyone involved a ton of money and headaches.
